How Vitamins Stimulated the Debate on Private Antitrust Litigation
The following article examines the ability of foreign plaintiffs to bring private antitrust claims in foreign jurisdictions. The paper examines, in particular, the controversial Vitamin Cartel using Empagran S.A. v. F. Hoffman-LaRoche Ltd., a US Supreme Court decision, and Provimi Ltd. v. Aventis Animal Nutrition SA and Others, a decision by the English High Court, as a means by which to examine the current case law. The paper also seeks to understand the implications of these decisions in an EU/US context and the future of such claims.
