Health Insurance and European Competition Law

In a preliminary ruling on 16th March 20041 the ECJ had to assess whether certain Krankenkassen (sickness funds) of the German statutory health insurance system qualify as undertakings within the meaning of Art. 81 EC and, therefore, fall within the ambit of European competition law (Case C-264/01 and others – AOK Bundesverband, in the following referred to as the AOK judgment). The ECJ held that the funds in question fulfilled an exclusively social function, which is founded on the principle of national solidarity and is entirely non-profit making. It concluded that European competition law is not applicable to the core -activities of such sickness funds, including the fixing amongst themselves of contributions payable by them towards the purchase costs of medical products.
