Will sustainability and environmental considerations be the next big hit for shaping the application of Article 102 TFEU?
The German Federal Cartel Office’s (FCO) proceedings against Facebook have made big waves. The FCO used antitrust instruments, but based its action on a violation of data protection regulations. This action could serve as a blueprint for the violation of other non-competitive regulations, such as the violation of sustainability and environmental goals. This paper explores whether and how specifically Article 102 TFEU can serve in implementing sustainability and environmental considerations.
