The Law and Economics of Article 82 EC and the Commission Guidance Paper on Exclusionary Conduct1

This article discusses the approach to Article 82 in O'Donoghue and Padilla's book “The Law and Economics of Article 82 EC'' (Hart Publishing, Oxford 2006), compares it with the new European Commission Guidance Paper on the Commission's enforcement priorities in applying Article 82 EC to abusive exclusionary conduct by dominant undertakings2 and addresses some aspects of competition law remedies.
